This is an application for removal of an arbitrator under section 14 of the Arbitration & Conciliation Act, 1996 and for the appointment of an independent arbitrator.

The question of appointment of an independent arbitrator would arise only in the event of the petitioner succeeding in the application under section 14 of the Act. The application under section 14 does not pertain to my assignment.

In the circumstances, the petition is disposed of with liberty to the petitioner to file a petition under section 11 of the Act in the event of the petitioner successfully challenging the appointment of the arbitrator by respondent No.2. It is clarified that I have expressed no opinion regarding the maintainability of this application even under section 11 as far as respondent No.1 is concerned.
