 9 for grant of anticipatory bail in FIR No.251 dated 15.10.2023 under Section 306 IPC registered at Police Station Model Town, District Hoshiarpur.

As per facts of the case, complainant - Kamaljit gave her statement that her daughter Rita Devi got married with Amrik Singh in the year 2010. Out of this wedlock, she was having two daughters - elder daughter aged about 11 years old and younger daughter about 9 years old. Victim - Rita Devi was being harassed in the matrimonial home by her husband Amrik Singh and other members of in-laws family. They were unhappy with the birth of two daughters. Her husband was pressurizing her to give him divorce to which victim did not agree. Amrik Singh went to


Dubai and he stopped sending expenses to his wife and daughters. He had filed a divorce case which was later-on withdrawn. About 7-8 months ago when Amrik Singh came India he had given beating to his wife i.e. victim. On 14.10.2023 Simran had sent voice message on whatsapp of her massi that her mother had consumed poison. On that day she (complainant) was already going to the house of her daughter and on reaching there she came to know that her daughter committed suicide by consuming poison. She remained under treatment at IVY Hospital, Hoshiarpur then shifted to Narad Hospital Hoshiarpur where she ultimately expired.

Learned counsel for petitioner argued that allegations levelled against him are without any basis. At the time of said occurrence, he was in Dubai. He was sending money to his wife time to time through hadi exchange services. The downloaded copy of said record is Annexure P-2. Allegations levelled against him are without any basis. He has also annexed copy of his passport (Annexure P-4). It is submitted that he is ready to abide by the terms of bail order. Therefore, his anticipatory bail may be allowed. 4.

Bail application is opposed by learned counsel representing State. Status report is filed. It is argued that present petitioner is specifically named. Rita Devi wife of present petitioner consumed poison due to harassment caused to her by her husband. She died unnatural death. Custodial interrogation of petitioner is very much required. Therefore, his anticipatory bail may be declined.

I have considered the arguments and have gone through the record. It is a case of unnatural death of victim Rita Devi. She has left behind her two daughters. Occurrence took place in the matrimonial home.

Petitioner has placed on record copy of his passport (Annexure P-4) showing his departure for Dubai on 09.06.2023 and he returned back India on 20.12.2024 whereas occurrence took place on 14.10.2023. It clearly shows that present petitioner was not in India when said incident took place. Petitioner is ready and willing to join the investigation as and when required. Considering the facts and circumstances of the case, anticipatory bail filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.
