(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.176 dated 24.09.2020 under Sections 323, 324, 326, 148, 149 IPC (Section 201 IPC added later on) registered at Police Station Division No.1, Police Commissionerate, Jalandhar who are in custody since 24.09.2020.

Counsel for the petitioner herein would contend that no injury has been attributed to the petitioner in the FIR. It is only stated that he was armed with iron rod. It is further contended that the co-accused Sudhir Kumar, who had inflicted simple injury upon the complainant has already been allowed interim anticipatory bail by this Court vide order dated 31.12.2020 passed in CRM-M No.44328 of 2020.. Learned counsel appearing for the respondent-State opposes grant of regular bail to the petitioner, while contending that no ground is made out for concession of regular bail, however, does not dispute the fact that the co-accused has been allowed interim anticipatory bail. CRM-M No.313 of 2021 (O&M) -2I have heard learned counsel for the parties. Keeping in view the fact that the petitioners are in custody since 24.09.2020 and the co-accused has been allowed interim anticipatory bail by this Court, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
