* * * * S.J. VAZIFDAR, C.J. (ORAL) This is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 (in short the Act) for the appointment of an arbitrator.

The petition has been directed to be taken on board on 17.11.2017. However, it is taken on board and disposed of without notice to the respondent as the order is in favour of the respondent.

The petitioner had filed an application under Section 9 of the Act for interim reliefs before the learned Additional District Judge, SAS Nagar, Mohali. The learned Additional District Judge returned the petition for presentation before the Court of competent jurisdiction. The learned Additional District Judge held that in view of the provisions of the agreement, the Courts at Mumbai had exclusive jurisdiction. I have by a separate order and judgement passed today in CR-7016-2017 upheld that judgement.

In view thereof, the learned counsel appearing on behalf of the petitioner seeks to withdraw the present petition with liberty to file the same in a Court of competent jurisdiction.
