* * * * S.J. VAZIFDAR, A.C.J. (ORAL) This is a petition for the appointment of an arbitrator. 2.

The petitioners carried on business as partners of the firm in the name and style of M/s Kay Pee Industries under the deed of partnership dated 01.04.2012. Subsequently, the petitioners and the respondents entered into partnership on the terms and conditions contained in a "Reconstitution Deed". Clause 17 thereof contains an arbitration agreement. Thereafter, the petitioners retired from the partnership on the terms and conditions contained in a document dated 15.01.2014. The petitioners now seek to recover the amounts due under the retirement deed. 3.

The petitioners' claim falls within the ambit of the partnership deed itself which as noted earlier contains an arbitration agreement. 4.

In these circumstances, the petition is disposed of by appointing Mr. S.S. Sodhi, former Chief Justice of the Allahabad High Court, as the sole arbitrator.
