The appellant is challenging the judgment dated 29.11.2023 of Single Bench, whereby the writ petition filed by respondent-Maya Ram, who was working on the past of Superintendent seeking benefit of pay scale of Pay Band-2 with grade pay of Rs.5400/-, has been allowed. 2.

Keeping in view the notification of Government of Haryana, Finance Department, dated 06.01.2010 (Annexure P-1) and a perusal of the judgment would show that the respondent was promoted on the post of Superintendent on 16.10.2008 and in the writ petition, detail of the ACRs has been given at Page 78. A perusal of the ACRs show that from 2008-2009 till 2010-2011, the respondent had got three good reports and GEETA RANI 2024.01.22 10:03 I attest to the accuracy and authenticity of this order/judgment

LPA-147-2024 (O&M) -22024:PHHC:006584-DB in 2011-2012, he had got 'below average' and for the year 2012-2013 to 2014-2015, he had got good reports. On the basis of these ACRs, his writ petition has been allowed by the learned Single Bench. That he has continuing service of four years as per the rules on the post of Superintendent and he has been granting the benefit from the year 2013. 3.

Learned counsel for the appellant has not been able to show any rule whereby three good reports and one below average report can be made basis for the denial of claim of the petitioner. 4.

In view of the above, we do not find any merit, hence, the Letters Patent Appeal is dismissed.
