(Oral) Petitioner has preferred this petition under Section 11 (5), (6), (7) and (8) of the Arbitration and Conciliation Act, 1996 for appointment of an independent arbitrator. In view of directions issued by the Hon'ble Apex Court in Special Leave Petition (Civil) No.5306 of 2022, all pending applications under Section 11(5) and 11(6) of the Arbitration Act/or any other application either for substitution of arbitrator and/or change of arbitrator, which are pending for more than one year from the date of filing, must be decided within six months from 19.05.2022.

This case was filed in the year 2017.

ARB No. 261 of 2017 (O&M) -2The case was adjourned on 12.07.2022 to 06.09.2022 on the request of learned counsel for the petitioner who was stated to be in personal difficulty. On 06.09.2022 also, due to some unfortunate demise in the family of Mr. A.K. Tewari, Advocate, the case was adjourned to 20.09.2022. Turn of the case did not reach on 20.09.2022 and i.e. how, the case is fixed for today.

None has appeared on behalf of the petitioner. In view of directions already issued by the Hon'ble Apex Court, no further adjournment is to be granted. Dismissed for non-prosecution.
