(Oral) This is a petition under Sections 11(5), (6)(A) & (C) of the Arbitration & Conciliation Act, 1996 (in short 'the Act of 1996') read with the Arbitration & Conciliation (Amendment) Act, 2015 (in short 'the Act of 2015'), for appointment of an independent sole arbitrator.

Learned counsel for the petitioner(s) referred to Clause 64.3 of the Contract/Agreement, which relates to the 'Appointment of Arbitrator' in the case of disputes between the parties.

Upon notice of motion having been issued, respondents had appeared and filed reply. However, today, during the course of arguments, learned counsel for the respondents stated that respondents have no objection for appointment of a sole Arbitrator by this Court.

Accordingly, the petition is disposed of by appointing Ms. Puneeta Sethi, Advocate, #843, Sector 16-D, Chandigarh, as the sole arbitrator. The fees shall be as per the Chandigarh Arbitration Centre (CAC) (Administrative Cost and Arbitrators' Fees) Rules, 2014.
