This is an application under Section 11 of the Arbitration and Conciliation Act, 1996, for appointment of an Arbitral Tribunal.

It is not necessary to grant the respondents time to file an affidavit in reply as, on the terms of the agreement, this court would have no jurisdiction. Clause-60 contains an arbitration agreement which specifies that the arbitration would be conducted at Mumbai. Clause-61 provides that the agreement shall be subject to exclusive jurisdiction of the competent courts at Mumbai only for all matters arising out of and relating to this agreement. 3.
