S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):
This is an application under section 11 of the Arbitration & Conciliation Act, 1996 for appointment of sole arbitrator to adjudicate upon the disputes between the parties.

The arbitration clause contained in the agreement between the parties stipulates that the disputes and differences between the parties shall be referred to the sole arbitration of the Director (Marketing) of the respondentCorporation and if he is unable or unwilling to act, the same shall be referred to the sole arbitration of some other officer of the corporation to be appointed by the Director (Marketing).

The petition is, therefore, disposed of by directing the respondents to intimate the petitioner in writing on or before 31.10.2015 as to whether the Director (Marketing) will act as the Arbitrator or whether any other person nominated by him will act as the Arbitrator. In either case the name of the person appointed in accordance with Clause 69 shall be informed to the petitioner.
