M/s Isolux Corsan India Engg. & Construction Pvt. Ltd.

CORAM: HON'BLE MR. JUSTICE S.J. VAZIFDAR, ACTING CHIEF JUSTICE Present: Mr. Nirmaljeet Singh Sidhu, Advocate, for the petitioner.

None for the respondent.

* * * * S.J. VAZIFDAR, A.C.J. (ORAL) This is a petition for the appointment of an arbitrator. 2.

Technically, six separate petitions ought to have been filed. The petitioner invoked the arbitration clause in respect of six purchase orders placed by the respondent on the petitioner. The action is for the priced goods sold and delivered. Each of the purchase orders contains an arbitration agreement. It would, however, be necessary to have separate references and separate orders unless the parties agree to a common award. 3.

The petition is, therefore, disposed of by appointing Mr. B.L. Singal, retired District and Sessions Judge, Haryana, as the arbitrator to adjudicate upon the disputes and differences between the parties in respect of each of the six purchase orders. The references shall be separate. Separate awards shall also be passed unless the parties agree otherwise before the arbitrator.
