S.J. VAZIFDAR, A.C.J. (Oral) This is an appeal against the order and judgment of the learned Single Judge admitting a winding up petition and issuing the usual directions for having the admission order advertised. After the order was passed and before the order of admission was advertised, the parties settled the matter. In view thereof, by an order dated 26.02.2015, we stayed the impugned order as regards publication of the order of admission.
Counsel for the respondent agrees that a settlement has been arrived at in terms of the memorandum of understanding at Annexure A-1 to the appeal.
In our view any directions including for the stay of the operation of the order in so far as it directs the order of admission to be advertised ought to be sought in the first instance before the learned SHIVANI GUPTA 2015.04.10 10:33 I attest to the accuracy and integrity of this document Chandigarh

In the circumstances, the appeal is disposed of by granting the appellant liberty to apply to the learned Company Judge for orders consequent upon the parties having settled the matter. In order to enable the appellant to do so and in view of the respondents having admitted that the matter has been settled, the stay granted by this Court on 26.02.2015 directing that the order of admission shall not be published shall continue upto and including 30.04.2015.
