By the impugned order dated 05.12.2014, the learned Company Judge passed an order of winding up on the recommendations of the BIFR.

The appellant, who is the former Managing Director of the Company in liquidation, seeks to take the company out of the winding up. Any application or proceedings for the same must be filed, in the first instance, before the learned Company Judge. 3.

The appeal is accordingly disposed of.

As we have disposed of the appeal, delay in filing the appeal stands condoned.
