Mr. Sanjay Vij, Advocate, for the respondents. **** S.J.VAZIFDAR, CHIEF JUSTICE (ORAL) This is an application under section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of the sole arbitrator to adjudicate upon the disputes and differences between the parties. 2.

The parties entered into a contract, clause 12 thereof contains an agreement. The reference is to be the sole arbitration of the respondents' Managing Director which is not permissible in view of the amendment to the Act.

The disputes and differences have arisen between the parties. The petitioners invoked the arbitration clause. The contentions sought to be raised before me relate to the merits of the disputes which are not relevant to the application under section 11 of the Act.

The petition is, therefore, disposed of by appointing Mr. Justice Anil Dave, former Judge of the Supreme Court of India, as the sole arbitrator to adjudicate upon the disputes and differences between the parties.
