 ,  $-& The petitioner has filed this petition under section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of sole arbitrator to adjudicate upon the disputes and differences between the parties. 2.

Though learned counsel for the respondents tried to resist but could not dispute the fact that the agreement between the parties contains an arbitration clause and they have failed to appoint an arbitrator with consent. 3.

Accordingly, the petition is allowed. Hon'ble Mr. Justice Mukul Mudgal, former Chief Justice of this Court, is hereby appointed as sole arbitrator to adjudicate upon the disputes and differences between the parties. The fees shall be as per the Chandigarh Arbitration Centre (CAC) (Administrative Cost and Arbitrator's Fees) Rules, 2014 or as may be settled by the parties and the arbitrator.
