This is a petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 for the appointment of an arbitrator.

The petition is filed in respect of two agreements. Hence, there must be separate references.

The respondent has no objection to the appointment of an arbitrator, but in respect of the disputes between the newly added petitioner, namely, M/s Pashupati Nath Universal (P) Ltd. and the respondent.

The petition is, therefore, disposed of by appointing Mr. Justice R.C. Gupta, former Judge of the Delhi High Court, as the sole arbitrator in respect of the disputes and differences between the newly added petitioner and the respondent regarding each agreement. It is clarified that although the arbitrator is common, the references would be separate and separate awards shall be passed in respect of the disputes relating to each agreement.
