Mr. Yashpal Gupta, Advocate, for the respondent. **** S.J.VAZIFDAR, CHIEF JUSTICE This is an application under section 11 (6) of the Arbitration and Conciliation Act, 1996 for the appointment of sole arbitrator to adjudicate upon the disputes and differences between the parties. 2.

The parties had admittedly entered into an agreement, clause 10 whereof contains an arbitration agreement. The disputes and differences having arisen between the parties, the petitioner invoked the arbitration clause. The arbitration clause contemplates an arbitral tribunal consisting of three arbitrators. However, both the parties have requested that matter be referred to the sole arbitrator with a view to save the time and costs. 3.

The petition is accordingly disposed of by appointing Mr. Justice Sudershan Kumar Misra, a former Judge of the Delhi High Court, # C4/25, Safdarjang Development Area, New DelhiC110016, as the sole arbitrator to adjudicate upon the disputes and differences between the parties.
