The petitioner apprehending arrest in the FIR captioned above, had come up before this Court under Section 438 CrPC seeking anticipatory bail by filing the present petition.

Vide order dated 08.01.2024, the petitioner was granted interim bail, which is continuing till date.

Allegations against the petitioner are of acquisition of disproportionate assets i.e. 15.78% more than the income, which is Rs.12,82,280/-, during the check period w.e.f. 01.04.2009 to 31.03.2019.

Petitioner's counsel submits that they have voluntarily complied with the order dated 23.01.2024 and handed over affidavit to the investigator. 5.

State counsel does not dispute the contention made by counsel for the petitioner, however opposes the bail. He further submits that in case, this Court is confirming the bail, they should be permitted to verify the above said affidavit regarding declaration of assets.

Since the petitioner has declared his assets, there would be no justification to discontinue the interim protection, however, let the concerned Investigator verify the affidavit , if they so desire.
