The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.83 dated 25.6.2021, Police Station Khilcian, District Amritsar City under Sections 379-B(2), 341 and 34 of Indian Penal Code.

The FIR was lodged at the instance of Gursharan Singh, wherein the allegations are broadly to the effect that on 25.6.2021, three persons armed with 'datars' had forcibly snatched the keys of his motorcycle and had taken away an amount of Rs.250/- and his mobile phone. 3.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case. It has further been submitted that PANKAJ KAKKAR 2022.03.31 17:22 I attest to the accuracy and authenticity of this document
( 2 ) CRM-M-1172-2022 (O&M) since identically situated co-accused namely Jarman Singh has already been granted bail by this Court vide order dated 9.12.2021 passed in CRM-M36680 of 2021, the petitioner also deserves the same relief on grounds of parity.

On the other hand, learned State counsel, while opposing the petition, has submitted that since the petitioner has a chequered record and stands involved in three other cases, no case for grant of bail is made out. It has, however, been informed that the petitioner as on date has been behind bars since the last about 9 months and that while charges have been framed, not even a single PW out of the cited 30 PWs has been examined so far. 5.
I have considered rival submissions addressed before this Court. 6.
Without commenting anything as regards merits of the case but while noticing that the petitioner has been behind bars for a substantial period of about 9 months and the trial has not even commenced till date, further detention of the petitioner will not serve any useful purpose as conclusion of trial is likely to consume time. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
