This is the second petition under Section 483 of the B.N.S.S., 2023, whereby, the petitioner prays for grant of regular bail, in FIR No.165 dated 24.10.2022, under Section 21(C) and 29 of the N.D.P.S. Act, 1985 (Section 61/85 of the N.D.P.S Act added in Challan), registered at P.S. Sangat, District Bathinda.

Petitioner's earlier bail petition No. CRM-M-38043-2024 was dismissed as withdrawn vide order dated 12.08.2024. 3.

Succinctly stated, 03 kgs of heroin has been recovered in the instant case, which falls within the ambit of "commercial quantity". 4.

The learned State counsel, on instructions imparted to him by the official concerned, informs this Court that, the petitioner is involved in 31 more cases, out of which, he is facing trial in 12 cases, he has earned conviction in 03 cases, he has been acquitted in 08 cases and he has been on production warrants in 08 cases. CRM-M-130-2025 25 prosecution witnesses, 07 witnesses have already been examined and 07 witnesses have been given up by the public prosecutor being unnecessary, hence only 11 witnesses remain for examination. 5.

Taking into account: (i) the commercial quantity of the recovered contraband; (ii) the criminal antecedents of the petitioner; (iii) the fact that the trial is progressing at the right pace; and (iv) the fact that custody of the petitioner in the instant case is yet to commence, as he is undergoing sentence in other cases, wherein, he has been convicted; this Court is not inclined to grant the relief of regular bail to the petitioner. 6.

In summa, the instant petition is dismissed.
