**** RAJ MOHAN SINGH, J.(Oral) Petitioner has filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

Notice of motion was issued on 16.03.2018. On 24.05.2019, none appeared on behalf of the petitioner and the case was adjourned for 04.10.2019. On the adjourned date also, none appeared on behalf of the petitioner and the case was dismissed for non-prosecution on 04.10.2019. Thereafter the case was restored to its original number vide order dated 24.01.2020 passed in CM No.23298-CII of 2019. Thereafter the case was adjourned at the instance of respondents and even MOHMED ATIK 2022.10.18 10:53 I attest to the accuracy and authenticity of this order/judgment

ARB No.65 of 2018 (O&M) last opportunity was granted to them to file reply. Reply has not been filed by the respondents till date. Today none has appeared on behalf of the petitioner despite two pass overs.

In view of directions issued by the Hon'ble Apex Court in SLP (Civil) No.5306 of 2022, the case of present category which is pending for more than one year from the date of filing has to be decided within a period of six months from 19.05.2022. No further indulgence can be granted in this case. Dismissed for non-prosecution.
