PANKAJ JAIN, J. (ORAL) Challenge is to the order dated 4th of April, 2022 passed by Ld. Trial Court in FIR No.249 dated 20th of July, 2020 registered for the offences punishable u/s 20/29/61/85 of NDPS Act, 1985 and Section 212 of IPC, 1860 at Police Station Chandhut, District Palwal whereby the bail granted to the petitioner was cancelled and his bail bonds were ordered to be forfeited to State and further warrants of arrest have been issued against him.

While issuing notice of motion on 6th of January, 2023 following order was passed :

"Learned counsel for the petitioner inter alia contends that after grant of bail the petitioner had been appearing on all dates in his trial, except when specifically exempted and that on the date the impugned order was passed, he could not appear as he was undergoing treatment for lung infection. Learned counsel further undertakes on behalf of his client that his client shall appear in his trial on all dates in future, unless specifically exempted and that he DEEPAK KUMAR 2023.09.01 10:44 I attest to the accuracy and integrity of this document

CRM-M-380-2023 -22023:PHHC:113513 shall surrender before the Trial Court on the next date fixed before it i.e. 07.01.2023.

Notice of motion.

Mr. Abhinash Jain, DAG, Haryana accepts notice and prays for time to argue the matter.

Adjourned to 18.01.2023.

In case the petitioner surrenders before the Trial Court on 07.01.2023 the Trial Court shall admit him on ad interim bail to its satisfaction. While admitting him on ad interim bail the Trial Court shall insist on at least two heavy local sureties." 3.

Today Counsel for the petitioner has produced order dated 7th of January, 2023 passed by ASJ, Palwal which shows that the order passed by this Court dated 6th of January, 2023 stands complied with. 4.

In view thereof nothing survives for adjudication at the hands of this Court.

Consequently, the present petition is dismissed as having been rendered infructuous.
