JASGURPREET SINGH PURI , J. (ORAL ) The present habeas corpus petition has been filed for release of detenues mentioned in par 4 of the petition alleging that they have been illegally detained by respondent Nos.5 to 8. Notice of motion was issued to the State and the affidavit has been filed.
Learned State counsel has pointed out to para 8 of the affidavit which is reproduced as under:- "That the allegations levelled in the petition by the petitioner against the owner of Brick Kiln and his RAJ KUMAR ARORA 2020.02.29 10:44 I attest to the accuracy and integrity of this document
CRWP-50-2020 employees were found to be false. No labourer was kept as bonded labour by the owner of brick kiln. As per statement of labour contractor - Kallu, the petitioner Rakesh Kumar had obtained Rs.1,60,000/- from him at his village Kakra, District Muzzafarnagar (U.P.) for working as labourer at the brick kiln but neither the petitioner nor any of his related person has ever came to work at above noted brick kiln at village Jindalpur, District Patiala."
As per the affidavit, the allegations levelled in the petition have been found to be false as no labourer was kept as bonded labour.
In view of above, the present petition is hereby dismissed.
