RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Tarsem Singh - in a case arising from FIR No.119 dated 20.09.2018 registered under Sections 341, 324, 323, 506, 148, 149 IPC, Sections 25, 27 of the Arms Act, 1959 and later on added Section 326 IPC at Police Station Jhunir, District Mansa.

According to prosecution, in the morning of 20.09.2018, petitioner, his co-accused Satnam Singh and others, attacked and caused injuries to complainant Gurpal Singh. The petitioner putting a rope around the neck of the complainant, tried to drag him. Learned counsel inter alia contends that injury attributed to the petitioner has been declared simple in nature. He is in custody since 10.12.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. -2CRM-M-767 of 2020 On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Tarsem Singh - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
