Heard learned counsel for the parties.

The grievance of the petitioner in this writ petition is that the petitioner had preferred an Appeal No.02/DC/Cons/2021 dt. 27.12.2021 alongwith a stay application before respondent No.2, challenging the order dt. 10.12.2021 passed by respondent No.3-District Revenue Officer-cum-Settlement Officer, Consolidation, Karnal, and seeking stay of the said impugned order but respondent No.2 is not hearing the appeal preferred by the petitioner and is simply adjourning the same, which is now fixed for is 02.02.2022.

   Learned Counsel for the petitioner submits that there is every likelihood of the impugned order dt. 10.12.2021 being implemented in the meantime, and subject land being allotted to other parties; and if this is allowed to happen, great prejudice would be caused to the petitioner as the appeal would be rendered infructuous.

Mr. Samarth Sagar, Addl. A.G., Haryana, who had sought time earlier to obtain instructions, states that he is unable to contact respondent No.2 as he is busy in some other work. Since there is every danger of the appeal filed by the petitioner being rendered infructuous on account of delay in disposal of the stay application by respondent No.2, pending disposal of the stay application, status quo as on date shall be maintained in all respects, and respondent No.2 is directed to dispose of the said appeal or the stay application in the appeal, preferably within a period of four weeks from the date of receipt of copy of this order after hearing all the parties to the appeal.

Disposed of accordingly.
