Rakesh Kumar Jain, J. (oral) Learned counsel for the respondent has submitted that in the operative part of the order dated 6.8.2013, a direction had been issued to the respondent to promote the petitioner from the date when the person next junior to him was promoted and accord him all the consequential benefits. An order has been placed on record by the respondent dated 12.10.2015, as per which the petitioner was promoted notionally w.e.f. 01.03.1991 i.e. the date from which his immediate junior Surender Kumar was promoted and for next promotion to the post of Field Supervisor/Officer Scale-I, which was based upon merit, the petitioner has been called many times but was found unfit.

COCP-1120-2015 -2After hearing heard learned counsel for the parties and keeping in view the stand taken by the respondents, the present petition is disposed of as having been rendered infructuous.
