(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.60 dated 07.05.2016, registered under Sections 295, 511 and 120-B IPC at Police Station Sultanpur Lodhi, District Kapurthala and all subsequent proceedings arising therefrom, on the basis of compromise.
Pursuant to order dated 09.04.2019 of this Court, the parties appeared before the trial Court on 16.05.2019 along with receipts of `15,000/- to get their statements recorded. Learned Sub Divisional Judicial Magistrate, Sultanpur Lodhi, has submitted his report vide letter bearing No.559 dated 17.05.2019 duly forwarded by learned District and Sessions Judge, Kapurthala, vide Endst. CRM-M-2205 of 2019 --2-- According to the report, ld. Sub Divisional Judicial Magistrate, Sultanpur Lodhi, is satisfied that appearing parties have effected compromise, which is genuine, voluntary and are not the result of any threat, pressure or coercion etc. in any manner. Petitioners No.5, 6 and 8 did not turn up for recording their statements qua compromise. No accused has been declared as proclaimed offender. Considering the report of ld. Sub Divisional Judicial Magistrate, Sultanpur Lodhi, dated 17.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.60 dated 07.05.2016 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners, except petitioners No.5, 6 and 8. Disposed of accordingly.
