The petitioner seeks grant of regular bail in respect of a case registered against him vide FIR No.234, dated 31.10.2020, Police Station Rajaund, District Kaithal, under Section 20(b) of NDPS Act. 2.

It is not disputed that challan already stands presented and that the petitioner is not involved in any other case and that the petitioner as on date has been behind bars since the last more than two months. 4.

Having regard to the aforestated factual position wherein the petitioner is alleged to be a first offender and has already been behind bars since the last more than 2 months, further detention of the petitioner will not serve any useful purpose especially since challan already stands presented. The petition, as such, is accepted and the petitioner is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
