A father of a minor girl has come up before this Court under Article 226 of the Constitution of India seeking directions for releasing his daughter from illegal and unlawful custody of respondent Nos.4 to 7.

A perusal of the petition reveals that the girl is minor, her date of birth is being 06.09.2004.

Learned State counsel on instructions received from ASI Rajpal Singh, submits that an FIR has already been registered against the accused and search is on to trace the minor girl.

Given above, this petition is disposed of and respondent Nos.2 & 3 are directed to make all out efforts to trace the minor girl and once she is traced, to produce her before the concerned Judicial Magistrate for recording of statement under Section 164 of the Cr.P.C.

After recording of the judicial statement under Section 164 of the Cr.P.C. and interacting with the minor girl the concerned Judicial Magistrate shall decide whether the minor has to be sent to her parents or she has to be sent to any Child Protection Home till she attains the majority.
