(ORAL) Petition herein is, inter alia, for issuance of a writ in the nature of Mandamus directing the respondents to reserve a seat for the post of Sarpanch of Scheduled Caste category in village Haraj, Block Ghall Khurd, District Ferozepur as per amended Rule 3 of the Punjab Reservation for the Offices of the Gram Panchayats, Chairman and Vice Chairman of Panchayat Smities and Zila Parishad Rules 1994 (amended w.e.f. 10.04.2008 in light of Article 243 (D) of the Constitution of India).

Learned counsel for the petitioners submits that for redressal grievance of the petitioners, they have moved a representation dated 11.12.2023 (Annexure P-2), but the same has not been adverted by the respondents till date. 3.

On advance service of copy of petition, learned State counsel appears and opposes issuance of notice of motion. He submits that respondent No.2/ competent authority shall take decision either way, on the pending representation dated 11.12.2023 (Annexure P-2) of the petitioners. Given the nature of order being passed, there is no necessity to seek reply by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case and considering the relief sought for herein, the writ petition is disposed of with a direction to respondent No.2/ competent authority to consider representation dated 11.12.2023 (Annexure P-2) of the petitioners and pass an appropriate order, in accordance with law, within a period of 04 weeks from the date of receipt of copy/ production of this order.
