Petitioner claims that the property of his brother Sardara Singh,who was unmarried and issueless, has been usurped by co-villagers by setting up a fabricated Will. Petitioner claiming to be Class-II legal heir of the brother,who died intestate, has also filed a suit wherein the veracity of the alleged forged Will is under adjudication. Petitioner is also stated to have filed a criminal complaint with regard to the forgery of the said Will and this Court in CRM-M 15195/2017 vide order dated 5.5.2017 directed the SHO concerned to look into the representation. Since no action has been taken hence the present petition.
At the time of hearing it is conceded that the matter essentially is of civil nature wherein the legality of the alleged Will is under consideration.
After hearing the learned counsel no case for invoking contempt jurisdiction is made out.
Dismissed.
