The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No. 96 dated 28.6.2021, Police Station Amargarh, District Sangrur under Sections 15/61/85 of Narcotic Drugs & Psychotropic Substances Act.

The FIR was lodged on the basis of secret information received by the police to the effect that Gurcharan Singh @ Pauhli and Balwinder Singh @ Rubi (petitioner) indulge in sale of 'poppy husk' after procuring the same from Madhya Pradesh and that they had stored huge quantity of 'poppy husk' in outer courtyard of Saini Rajputana Dharmshala. Pursuant to receipt of said information a raid was conducted and 30 plastic bags of 'poppy husk' (each PANKAJ KAKKAR 2022.01.10 17:13 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-494-2022 (O&M) containing 10 kilograms of 'poppy husk') were recovered from the nominated place. However, no one was arrested from the spot. 3.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case and that the alleged secret information does not have any basis regarding complicity of the petitioner. 4.
I have heard the learned counsel for the petitioner. 5.
The instant petition is the second petition filed on behalf of the petitioner seeking grant of anticipatory bail. The earlier petition is stated to have been withdrawn with liberty to surrender before the Trial Court so as to apply for grant of regular bail. In any case, this Court finds that apart from the fact that there was prior secret information, the antecedents of the petitioner, who happens to be involved in 5 other FIRs, do not warrant grant of anticipatory bail.
