Petitioners 1 and 2 are residents of Village Adhoya,Tehsil Pehowa, District Kurukshetra. They filed CWP 11403/2017 seeking a direction for removal of encroachments on the shamlat land. The said writ petition was disposed of vide order dated 20.7.2017 relegating the petitioners to file an eviction application under Section 7 of the Punjab Village Common Lands(Regulation) Act,1961 with a further direction to the Assistant Collector to decide the same expeditiously. Present contempt has been filed with the averments that the eviction petition filed by the Gram Panchayat in the year 2016 qua removal of the same encroachments has not yet been decided. However, it is conceded that petitioners to date have not filed any application. Therefore, there would be no contempt of the order dated 20.7.2017.

After arguing for sometime and having failed to convince the Court,learned counsel seeks permission to withdraw the present petition. Dismissed as withdrawn.
