(ORAL) Instant petition has been filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.173 dated 08.07.2020 registered under Section 61 of Excise Act, 1914 at Police Station Sardulgarh, District Mansa.

Learned counsel for the petitioner submits that the petitioner has been in custody since 22.11.2020 in a case of false implication. That the petitioner was not apprehended at the spot and recovery of 50 liters of Lahan along with the working still was shown to have been effected from his house. Learned counsel further submits that there is no likelihood of the trial concluding in the near future as only challan has been presented in the case in hand. Per contra learned State counsel on instructions while opposing the prayer made by learned counsel for the petitioner has apprised this Court that the charges are likely to be framed shortly. He has admitted that the petitioner is not involved in any other criminal case except the present one.

Heard.

Keeping in view the fact that the petitioner has been in custody since 22.11.2020 and due to the outbreak of the pandemic Covid-19, the trial is unlikely to conclude in the near future, I deem it a fit case to grant the concession of bail to the petitioner. Therefore, without expressing anything on the merits of the case, the instant petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the trial Court/Duty Magistrate concerned.
