(ORAL) The petitioner is seeking regular bail in FIR No. 136 dated 24.2.2018 under Sections 147, 148, 149, 324, 307 (added later on) IPC registered at Police Station Sector-5, District Panchkula. Learned counsel for the petitioner submits that petitioner has not been named in the FIR and no specific role has been attributed to him. He further submits that the petitioner has been in custody since 26.2.2018 and charges were framed on 11.9.2018. Learned counsel also submits that co-accused Birju has been granted regular bail by this Court on 22.11.2019 (Annexure P-3) Learned State counsel, on instructions from ASI Yog Dhayan, submits that the injured had suffered three injuries on his parietal bone and one injury was declared as dangerous to life which has been attributed to coaccused Sunil. CRM-M No. 194 of 2020 -2were framed on 11.9.2018 and the trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
