The present petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.0063 dated 25.07.2022 registered under Sections 406, 498-A of the Indian Penal Code, 1860 and Section 04 of the Dowry Prohibition Act, 1961 at Police Station City-II Abohar, District Fazilka. 2.

On 22.03.2023 the following order was passed : "The present petition has been filed inter alia praying for grant of anticipatory Bail in case FIR

-2No.0063, dated 25.07.2022, under Sections 406 and 498-A of the Indian Penal Code, 1860, and Section 4 of the Dowry Prohibition Act, 1961, registered at Police Station City-II Abohar, District Fazilka.

Mr. Jaswinder Singh Grewal, Advocate has put in appearance and filed his Memorandum of Appearance on behalf of respondent No.2, which is taken on record. Learned counsel for the petitioner submits that, since, the parties have compromised the matter and the second motion under Section 13-B of Hindu Marriage Act is listed for 27.03.2023, before the Court below, the petitioner may be granted the concession of anticipatory bail.

Adjourned to 02.05.2023.

The arrest of the petitioner in the said FIR shall remain stayed till the next date of hearing only." 3.

Learned counsel for the petitioner would contend that the parties have since compromised the matter. It is further contended that their statements have been recorded qua the compromise quashing on the basis of the compromise dated 03.06.2022.

Learned counsel for respondent No.2 states that respondent No.2 would have no objection if the order dated 22.03.2023 granting anticipatory bail to the petitioner is confirmed.

Learned counsel for the State has reaffirmed that the parties have since compromised the matter and that the petitioner has since joined investigation and is fully co-operating and that he is no longer required for further custodial interrogation as of now.

In view of the above, the order dated 22.03.2023 is made absolute. The petitioner shall, however, join investigation as and when called for. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973. 7.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
