Petitioner is a co-sharer in a residential property qua which she has already filed a suit for separate possession by way of partition to the extent of her share. In the said suit status quo with regard to change in nature of suit property already stands ordered on an application for interim injunction.

Petitioner filed CRM-M9650/2018 with the averments that the co-sharers were forcibly taking possession of the property of the petitioner and have also started construction thereon. The said writ petition was disposed of by this Court vide order dated 7.3.2018 directing the SSP SAS Nagar, Mohali to look into the representation of the petitioner with regard to protecting her life and liberty.

Now present contempt has been filed primarily with the allegations that the respondent/co-sharer(s) in violation of the interim injunction order dated 4.4.2018 are raising construction at a break neck speed and therefore, petitioner claims that the directions contained in the Rajinder Parshad Joshi 2018.04.24 17:48 I attest to the accuracy and integrity of this document

COCP 1268/2018 order dated 7.3.2018 (P-1) have been violated. After arguing for sometime and having realized that the proper remedy,if any, is under Order 39 Rule 2-A CPC, prays for permission to withdraw the present contempt petition.

Dismissed as withdrawn.
