Petitioner is a beneficiary of an award dated 16.3.2017 passed by the Labour Court,Hisar in his favour whereby reinstatement with continuity of service has been granted.

In CWP 25587/2017 filed by the employer Department, this Court while issuing notice of motion has made a conditional stay of the award i.e. subject to compliance of Section 17-B of the Industrial Disputes Act,1947.

Present contempt has been filed alleging that there is no compliance of Section 17-B of the Industrial Disputes Act,1947. At the time of hearing realizing that due to non-compliance, the award itself becomes executable, counsel prays for permission to withdraw the present contempt petition so as to enable the petitioner to avail alternative remedy.
