Petitioners allege that the order dated 28.11.2017 passed by a Division Bench of this Court has been violated as Estate Officer, HUDA has not yet taken any decision on the show cause notice issued to the British School, Sector 12,Panchkula under Section 17 (3) of the HUDA Act,1977, for resumption of the plot due to upgradation of the school from Nursery to High School in violation of the terms of allotment. After hearing counsel for the petitioner no ground to invoke contempt jurisdiction is made out as the Hon'ble Division bench had accepted the limited relief of an opportunity of hearing to the petitioners before taking any final decision by the Estate Officer, HUDA. There is no such direction for taking immediate decision. At this stage,counsel prays for permission to withdraw the petition.
