The petitioner is stated to be a genuine member of Saraswati Kunj Cooperative House Building Societies Limited, Wazirabad, Gurgaon. Inspite of possession of the allotted plot having been handed over, the conveyance deed was not registered by the Society in favour of the petitioner-allottee ostensibly on the ground that number of allottees were much more than the actual plots available in the light of serious dispute inter se between the various members inducted at different points of time by different managements of the Society. The writ petition filed by the petitioner was disposed of with with the direction that in case he makes an application before the Assistant Registrar,Cooperative Society regarding his grievance the same would be decided in accordance with law. Since the needful was not done within the stipulated time hence the present contempt. It so transpires that keeping in view the protracted litigation and inter se dispute between members, the Government had appointed a Rajinder Parshad Joshi 2018.03.16 15:35 I attest to the accuracy and integrity of this document

COCP 1395/2016 Commission to submit a comprehensive report after examining in detail the entire records.

At the time of hearing counsel for the State has filed an affidavit dated 12.3.2018 of Rishi Kumar, Assistant Registrar, Cooperative Societies,Gurugram wherein it is stated that the Commission has submitted its report dated 5.8.2017 to the Government and the process is on for inviting objections from the aggrieved members. The final adjudication shall be completed by the Commission after considering the objections. It is submitted that the petitioner is free to file his objections on the basis of representation which have now been supplied to him, before the Commission.

In response counsel for the petitioner concedes that no further proceedings are warranted in the present contempt petition. Disposed of accordingly.
