PANKAJ JAIN, J. (ORAL) On 10th of January, 2020, the following order was passed :- "Counsel for the petitioner states that the petitioner is ready to take the wife to the matrimonial home and to settle down with her.

Notice of motion.

On oral request of counsel for the petitioner, complainant-Gurpreet Kaur is ordered to be impleaded as respondent No.2.

Dasti only.

Petitioner shall file an amended memo of parties with the Registry within three days from today.

Matter is referred to Mediation and Conciliation Centre of this Court.

Parties are directed to appear before the Mediation and Conciliation Centre of this Court on 03.02.2020. DEEPAK KUMAR 2022.05.12 10:03 I attest to the accuracy of this document

CRM-M No.648 of 2020 -2However, the petitioner-husband shall pay a sum of Rs.20,000/- to respondent-wife on her appearance before the aforesaid Centre as litigation expenses, which shall be a condition precedent for initiation of mediation proceedings. For awaiting report, list on 12.03.2020.

Meanwhile, till the next date of hearing, arrest of the petitioner shall remain stayed."

On 1st of September, 2021, it was brought to the notice of the Court by Counsel for the complainant that the litigation expenses as awarded vide order dated 10th January, 2020 were not paid. Thereafter, the matter was adjourned to 19th of January, 2022. On that date, none appeared on behalf of the petitioner. Position remains the same even today. Ld. Counsel for the complainant reiterates that the order dated 10th January, 2020 has not been complied with till date. Resultantly, the present petition is dismissed for nonprosecution.
