*** JASWANT SINGH, J.(ORAL) Vide interim order dated 26.5.2016 passed in CWP 25709/2015, proceedings dated 22.9.2015 of DPC re-fixing seniority between petitioner, and one Rishi Pal Saini was stayed. In the said proceedings Rishi Pal Saini was promoted to the post of Private Secretary w.e.f. 9.8.2012,already held by petitioner, whereas petitioner was ordered to be treated to have been promoted as Superintendent from 9.8.2012. In the instant contempt petition, it is alleged that despite stay granted by this Court vide order dated 26.5.2016 petitioner is not allowed to join on the post of Private Secretary.

Upon notice,reply by way of affidavit of Renu S.Phulia,Director, Women & Child Development Department has been filed stating therein that petitioner has been allowed to work on the post of Rajinder Parshad Joshi 2017.04.05 17:10 I attest to the accuracy and integrity of this document Private Secretary while said Rishi Pal Saini will perform his duties as

COCP 1414/2016 Personal Assistant till the decision of CWP 25709/2015. It is further stated that petitioner has already joined as Private Secretary on 29.6.2016. At the time of hearing counsel for the petitioner concedes that with the compliance of order dated 26.5.2016, the instant contempt has been rendered infructuous.

Dismissed as infructuous.
