**** Manjari Nehru Kaul, J. (Oral) Prayer in the instant petition filed under Section 24 of CPC for transfer of Divorce Petition under Section 13 of Hindu Marriage Act filed by the respondent titled as Sewa Singh vs. Somwati bearing DMC/279/2021 from the Principal Judge, Family Court, Rohtak to Family Court, Charkhi Dadri.

The sole ground for seeking transfer of the case in question from Family Court, Rohtak to Family Court, Charkhi Dadri is that the applicant has no source of income. Hence, it would be very difficult for her to pursue the litigation imposed upon her at the instance of her husband. On being put to notice, Mr. Sarvesh Malik, Advocate has put in appearance for the respondent and submits that the respondent is willing to bear the travel expenses of the applicant from Charkhi Dadri to Rohtak on each and every date of hearing.

TA-34-2022 -2Accordingly, the present petition stands disposed of with a direction to the respondent-husband to pay Rs.1,500/- to the petitioner wife on each and every date of hearing before the Family Court, Rohtak. However, it is clarified that in case there is any default in payment of aforesaid stipulated amount by the respondent-husband, an adverse inference would be drawn against him.
