The petitioner claims to be recorded owner in Khasra No.2248/2. He is stated to have purchased a plot measuring 360 square yards out of land measuring 2 Kanals 9 Marlas,situated at Hadbast No.74, Rohtak, Tehsil and District Rohtak vide sale deed dated 4.7.1983. The said plot is further stated to be on the Sugar Mill Road,Rohtak. The mutation was sanctioned as per the share purchased and was duly recorded. Joint land of the aforesaid khasra including the plot was acquired vide notification dated 24.12.2007 under Section 4 of the Land Acquisition Act for the purpose of Sector 14 and 18-A,Rohtak and further an award no.7 dated 23.6.2010 was passed by the Land Acquisition Collector,Rohtak. The grievance of the petitioner was that no compensation had been released, however, possession stood taken by the HUDA Authorities.

Since the compensation was not released, petitioner filed CWP 16195/2017 which was disposed of vide order dated 31.8.2017 with a direction to the official respondents/Authorities to pass a speaking order. Rajinder Parshad Joshi 2018.01.

COCP 142/2018 At the time of hearing, from the pleadings it transpires that the awarded compensation qua the entire land in the khasra,including that of the plot in question stood deposited in the Court of Additional District Judge,concerned by the HUDA Authorities. Therefore, the grievance,if any has to be raised by the petitioner by filing a proper application under Section 30 of the Land Acquisition Act.

Dismissed.
