(ORAL) When confronted with clause 26 of the NIT for supply of school uniforms, which provides for arbitration, learned senior counsel appearing for the petitioner submits that it may be permitted to avail the said remedy. Ms. Anu Chatrath, learned Additional Advocate General, Punjab, appearing for respondent No. 1 as well as Mr. Birinder Pal, learned counsel, appearing for respondent No. 2, submit that they have no objection to the same and in case any claim is filed by the petitioner, the same would be taken up in arbitration. They further submit that the parties also give consent and agree to engage Hon'ble Mr. Justice M.S. Sullar (a retired Judge of this Court) as an arbitrator as in respect of the same NIT, another arbitration proceeding has already been decided by him.
In view of the aforesaid submission made by learned senior counsel for the petitioner as well as the statement made by learned State counsel for respondent No. 1 as well as learned counsel for respondent No. 2, the writ petition stands disposed of.
