*** Daya Chaudhary, J. (Oral) The present petition has been filed by the petitioner under Section 439 Cr.P.C. for grant of regular bail to him in case FIR No.99 dated 18.06.2018 registered under Section 379-B read with Section 34 IPC at Police Station Maqsudan, District Jalandhar during pendency of the trial. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case whereas he was not involved. The petitioner is in custody since 18.06.2018. As per allegations levelled in the FIR, the petitioner and his co-accused had snatched the purse of the complainant containing ATM Card, Visa HDFC Bank, Aadhar Card, Identity Card and a tablet make Samsung.

Co-accused of the petitioner, namely, Kirandeep Singh, against whom similar allegations are there, has been released on regular bail by this Court vide order dated 17.12.2018 passed in Criminal Misc. No. M-47463 of 2018. One more case is pending against the petitioner as well as his co-accused and both of them are on bail. NEETU RANI 2019.02.

Learned State counsel has not disputed the custody period as well as the release of co-accused on regular bail by this Court. Heard arguments of learned counsel for the petitioner as well as learned State counsel and have also perused the contents of the FIR and other documents available on the file.

By considering the fact that the petitioner is in custody since 18.06.2018; his co-accused, namely, Kirandeep Singh has been released on regular bail by this Court; the trial may take time to conclude and no purpose would be served by keeping the petitioner in custody, the present petition is allowed and the petitioner (Navinderjit Singh @ Raja) is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court.
