NIRMALJIT KAUR, J. (ORAL) The present contempt petition is filed for non-compliance of the order dated 22.03.2016, Annexure P1.
Reply has been filed. As per the said reply, the order has been complied with by way of passing a speaking order dated 21.12.2017, Annexure R1.
A perusal of the said order shows that in fact claim of the petitioner has been rejected on the ground that a Division Bench vide order dated 29.01.2014 passed in CWP-4205-2010 has restrained the respondents from allotting any flats, plots in favour of their employees against 2% reservation provided under the Rules. Thus the respondents could not have rejected claim of the petitioner. Learned counsel for the respondents accordingly states at Bar that the said order be considered as having been withdrawn and liberty be granted to them to pass a fresh speaking order after hearing the petitioners after the final decision of CWP-4205-2010 or on account of any further development.
In view of the above statement, contempt petition is disposed of with the observation that the respondents will be bound by the above statement.
