*** Daya Chaudhary, J. (Oral) Learned State counsel submits that custody of the petitioner is approximately four months and one more case under the NDPS Act is also pending against him whereas learned counsel for the petitioner submits that the petitioner is on bail in that case.
Certain facts are missing in the petition as in para no.4, it has been mentioned that the petitioner was apprehended on 10.04.2017 and thereafter, nothing has been mentioned. Simply it has been mentioned that the petitioner is in custody for the last two months. Learned counsel for the petitioner wants to withdraw this petition with liberty to file fresh one with better particulars.
