**** Manjari Nehru Kaul, J.(Oral) Instant petition has been filed under Section 482 Cr.PC for quashing the order dated 21.09.2022 passed by Addl. Sessions Judge, Kapurthala (Annexure P-3) in FIR No.26 dated 14.03.2020 on account of his non-appearance during trial his bail bonds and surety bonds were cancelled and forfeited to the State.
Learned counsel for the petitioner submits that the petitioner had been regularly appearing before the trial Court, however, on 21.09.2022 since he was running high temperature, he missed the train from Shri Hazoor Sahib to Jalandhar and hence, he was unable to appear before the trial Court. Learned counsel further submits that the petitioner is ready to appear and join proceedings before the trial Court. In view of the submissions made above, the petition is disposed of with direction to the petitioner to appear and surrender before the trial Court on or before 17.01.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioner fails to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to him. 10.01.2023 (MANJARI NEHRU KAUL) sonia JUDGE Whether speaking/reasoned:
