******* SURINDER GUPTA, J.(Oral) Above captioned petitions are being disposed of vide this

common order. For the sake of brevity, facts are being extracted from COCP No. 1648 of 2019 (Rajender Kumar vs. Dr. Amarinder Kaur and another).

Heard.

Writ petition (CWP-20972-2013) filed by the petitioner was allowed in terms of order dated 28.05.2014 passed in CWP-10017-2011 (Khajjan Singh and others vs. State of Haryana and others). Learned State counsel has brought to my notice that against the order passed in CWP10017-2011, LPA-948-2015 was filed by the State, which was dismissed on 21.07.2015. State of Haryana filed Special Leave Petition (C) Nos. 51795188 of 2016 against order passed in aforesaid LPA and Hon'ble Apex Court vide order dated 08.04.2016 has directed that there shall be stay of contempt proceedings before the High Court qua implementation of order passed in CWP-10017-2011. Even against the writ petition (CWP-31712015) filed by Raju @ Rajpal and others, whose petition was also decided vide order dated 07.05.2015, Special Leave Petition (Civil) No.

35671 of 2019 has been filed and implementation of order has been stayed. Learned counsel for petitioners submits that aforesaid Special Legal Petitions in the Hon'ble Apex Court are pending. However, the Department has also filed Special Leave Petitions against order passed in the writ petitions filed by petitioners, Rajender Kumar, Rajwanti and Sumitra Devi, which have been dismissed. The Department has also regularized the services of Khajjan Singh and ten other similarly situated employees.

The writ petition of the petitioner was decided in terms of order passed in CWP-10017-2011 and Hon'ble Apex Court vide order dated

08.04.2016 passed in SLP (C) Nos. 5179-5188 of 2016 has ordered stay of contempt proceedings for non-compliance of order passed in aforesaid writ petition.

In view of above, these petitions are disposed of with liberty to petitioners to seek revival of the same on decision of the Special Leave Petition or to file fresh one, if so required. ( SURINDER GUPTA ) February 05, 2020 JUDGE jk Whether speaking/reasoned:
